THIS CAUSE came before the Court on Defendant, JPMorgan Chase Bank, N.A.’s (“Chase[’s]”) Motion to Dismiss Count III of the First Amended Complaint (“Chase’s Motion”) [ECF No. 43] filed on January 25, 2011, and on Defendant, Early Warn ing Services, LLC’s (“Early Warning[’s]”) Motion to Dismiss Counts I and II of the First Amended Complaint (“Early Warning’s Motion”) [ECF No. 42], filed on January 24, 2011. The Court has carefully considered the parties’ written submissions, the pleadings, and the applicable law.
