This suit was brought by appellee against appellant in the circuit court of Effingham county to recover damages resulting from the alleged failure of appellant to furnish electricity to the colleges, of " appellee according to the terms of an ordinance of the City of Effingham, which ordinance had been accepted by the appellant and under which it has been operating since June 14,1917.
