OPINION AND ORDER
This adversary proceeding is before the court upon the motion for summary judgment filed on November 2, 2010 by Nivea V. Pérez Mujica (hereinafter referred to as “Debtor” or “Plaintiff’) (Docket No. 29). Plaintiff argues that FirstBank Puerto Rico (hereinafter referred to as “First-Bank” or “Defendant”) does not have a mortgage lien over its real property and thus, is not a secured creditor. Debtor’s basis for her argument is that the mortgage lien over the real property in controversy, which was presented to the Property Registrar prior to Debtor’s filing of the bankruptcy…
