THIS MATTER is before the Court on remand from the Fourth Circuit Court of Appeals. [Doc. 47], The appellate court vacated this Court’s prior Order [Doc. 37] that granted summary judgment in favor of the Defendant, and remanded the matter to this Court for further consideration.
