In an action, inter alia, to recover damages for violations of Labor Law § 741, the plaintiff appeals, as limited by her brief, from so much of an order of the Supreme Court, Kings County (Jimenez-Salta, J.), dated October 28, 2014, as, in effect, converted the defendant’s motion pursuant to CPLR 3211 (a) to dismiss the complaint into a motion for summary judgment dismissing the amended complaint and thereupon granted the motion.
Ordered that the order is modified, on the law, (1) by deleting the provision thereof deeming the defendant’s motion to be one for summary judgment and, in effect,…
