FAY, Circuit Judge:

In this appeal, we are called upon to review an order of the United States District Court for the Middle District of Florida, dismissing the plaintiff’s complaint which sought review of an adverse determination by the Secretary of Health, Education, and Welfare. The plaintiff, William E. Viehman, on behalf of his daughter, Katherine E. Viehman, requested waiver of an overpayment of social security disability benefits pursuant to 42 U.S.C. § 404(b) (1976).
