This is the second appeal in this case. The first was from a judgment for the defendant in the circuit court, to the St. Louis Court of Appeals, where it was affirmed, (124 Mo. App. 165), but certified to this court on the statement of the judges that the decision was contrary to the decision of the Kansas City Court of Appeals in Huff v. Woodmen, 85 Mo. App. 96. The opinion of this court reversing the judgment of the St. Louis Circuit Court and remanding the cause for trial appears in 228 Mo. 675.
