In a previous Order (Doc. No. 34, filed April 2, 1997), the Court partially stayed proceedings and limited discovery to the issue of whether two of the three counts in Plaintiffs’ Amended Complaint are pre-empted by the Federal Insecticide Fungicide and Rodenticide Act (“FIFRA”), 7 U.S.C. §§ 136-136y.
