Limitations on governmental power in regard to its citizens is not a recent development. From the time people sought to govern themselves it became apparent that to secure fundamental rights it was essential to protect them against governmental intrusions, otherwise such rights would be empty. The founding fathers sought to protect certain rights which they considered fundamental against governmental interference.
