In the opinion of Justice *71Walker, delivered on a former appeal of this cause, (Ury v. Houston, 36 Tex., 265,) will be found a sufficient statement of the original pleadings, showing that the plaintiffs, claiming an undivided interest in the Lovick P. Dikes headriglit league and labor of land, brought their suit to recover the same from alleged trespassers, and also to have partition with other joint owners.
