The defendant was indicted for murder in the first degree of his wife, Marie Caruso, at Lawrence on July 2, 1922. The jury returned a verdict of “ Guilty of murder in the second degree.”

The defendant and his wife entered their home, where they lived together, about thirty minutes after ten o’clock on the night of July 1,1922. The defendant left his home the next morning about four o’clock, and a few minutes later, in company with his brother and a chauffeur, went by automobile to Salisbury Beach.
