The plaintiff in error, hereinafter called defendant, was adjudged guilty of a direct contempt in the district court of Creek county and was sentenced to pay a fine of $75 and to serve 10 days in the county jail.

The record discloses a state of facts about as follows: In a suit in the district court of Creek county wherein D. B. Jones was plaintiff and J. W.
