KRUEGER, Judge.

The offense is an assault with intent to commit murder. The punishment assessed is confinement in the State penitentiary for a term of three years.

The State’s evidence, briefly stated, shows that the alleged offense grew out of the purchase of two gallons of gasoline at the price of 12 cents per gallon. It appears that on the night of May 30, 1940, appellant and Jack Graves came to Mr. Red-ding’s place of business and filling station in Graves’ car; that appellant asked Redding to put two gallons of gasoline in the car, which he did.
