GUERNSEY, Chief Judge.

Plaintiffs Second Amended Complaint seeks damages from the Mohegan Tribal Gaming Authority under The Mohegan Tribal Discriminatory Employment Practices Ordinance, MTO 2002-04. The Plaintiff claims that a hostile working environment was created by Gary Surratt, Manager of the Licensing Department, by virtue of his alleged actions in repeatedly touching his genital area in the presence of employees, including the Plaintiff.
