OPINION AND ORDER
WILLIAM C. CONNER, Senior District Judge.
Plaintiffs Michelle Gualtieri (“M. Gualti-eri” or “plaintiff’) and her husband Ralph Gualtieri bring this action against Vassilki Portari Farina and Lawrence M. Farina, Jr. for personal injuries arising out of a motor vehicle accident that occurred on August 29, 2000. 1 Defendants bring the instant motion for summary judgment on the basis that M. Gualtieri has not sustained a “serious injury” pursuant to New York State Insurance Law Article 51. 2 For the reasons stated below, the defendants’ motion for summary judgment is granted.
