This action is brought to vacate and set aside a stipulation, order and judgment, made and entered in an aetiqn brought in 1904 by the Forest, Fish and Game Commissioner, in which the people of the ¡State of New York were plaintiff and the -Santa Clara Lumber Company, George K. Finch and George N.
