Plaintiff in error, Matteo Zalapi, filed his bill in the circuit court of Winnebago county against appellee, Holcomb & Hoke Manufacturing Company, in which he sought to set aside a written contract for the sale of a pop corn machine upon the ground that the contract was obtained by false and fraudulent representations, to cancel a note and chattel mortgage given in payment for the same to secure the return of money paid on said contract, and for an injunction restraining the foreclosure of the chattel mortgage.
