Joseph Doubet, senior, died intestate in Peoria county on December 19, 1909, leaving surviving him four sons, Joseph, Peter, Nicholas and Edward, and five daughters, and the children of a deceased son and of a deceased daughter, as his heirs at law, and seized of numerous tracts of real estate and of a large amount of personal property. On January 7, 1910, Nicholas and his wife filed a bill for partition of said real estate against the other heirs at law. This is the partition suit referred to in our opinion in Falor v.
