THORNBERRY, Circuit Judge:
Plaintiffs Mauricio and Dina Scokin, on behalf of their developmentally disabled daughter Davina, filed this suit seeking monetary and injunctive relief related to their unilateral decision to withdraw Davina from the Richardson Independent School District and place her at the Institute of Logopedics, a private residential institution. The action was brought under the Education of All Handicapped Children Act, 20 U.S.C. §§ 1401-1461 (EAHCA), section 504 of the Rehabilitation Act, 29 U.S.C. § 794, and the due process clause of the fourteenth amendment.
