This is an appeal by a former recipient of disability benefits from a summary judgment entered against him and in favor of the Secretary of Health and Human Services. Appellant John Van Horn began receiving disability benefits under the New York State disability benefit program in 1973. In 1974 that program was converted into the federally administered Supplemental Security Income (“SSI”) program.
