Andrews, J.:

Carmelo Genevola had a small butcher shop in the city of Rochester. It fronted upon the street and in the rear were apartments where he and his wife lived. Some time after-ten o’clock of the evening of November 12, 1921, two men entered the shop and after some conversation shot Genevola, inflicting a fatal.wound, and also shot his wife, who, on hearing the conversation, had appeared at the rear door.
