Plaintiff Monique D. Almy (“Plaintiff’), the Chapter 7 trustee for the bankruptcy estate of Bionicare Medical Technologies, Inc.’s (“Bionicare” or “Supplier”), has filed this action against Kathleen Sebelius in her official capacity as Secretary of the United States Department of Health and Human Services (the “Secretary”).
