Proceeding pursuant to CPLR article 78 (initiated in this Court pursuant to CPLR 506 [b] [1]) to, inter alia, prohibit respondent Essex County Judge from enforcing a trial order of dismissal in connection with a particular criminal action.

This proceeding arose as a result of a six-count indictment returned by the Essex County Grand Jury on May 20, 1996 charging respondent Richard E. Connors with attempted rape, sexual abuse and other related crimes allegedly committed against a 16-year-old female on or about February 17, 1996.
