MEMORANDUM OPINION

MORRIS SHEPPARD ARNOLD, District Judge.

Plaintiff Julie Ann Dodd Brasher sues under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1132(a)(1)(B), to recover certain death benefits under an insurance policy issued to her deceased husband, Terry Dodd, when he was employed by Prudential, that is, between October 5, 1987, and June 2, 1989. Plaintiff claims that at the time Terry Dodd terminated his employment with Prudential and until his death on November 26, 1989, he was “totally disabled,” a condition necessary for her to recover un der the policy.…
