¶ 1. This case comes to us after the trial court granted the City of Gautier's Motion For Summary Judgment. Plaintiff Kenneth Peden, Sr., filed a Motion For Injunctive Relief and Motion for Declaratory Relief in the Jackson County Chancery Court seeking to enjoin the enforcement of the chancery court's order in a separate action approving the City's annexation of the Gautier Utility District. Chancellor Jaye A. Bradley found that the Special Chancellor's order in the annexation case was dispositive of the issues raised in Peden's pleadings and that summary judgment was thus appropriate.
