Appeal from a judgment of the County Court of Albany County (Herrick, J.), rendered January 7, 2004, upon a verdict convicting defendant of the crimes of burglary in the second degree and petit larceny.

*761Defendant was charged by a two-count indictment with the crimes of burglary in the second degree and petit larceny based on allegations that he forcibly entered a City of Albany residence and stole various items of property.
