Mowbray, J.:

We have been asked in this certiorari proceeding to review the order of the district judge granting bail to Jack Van Sickle, who is a fugitive from justice from the State of California, where he has been charged with conspiracy to murder six persons, a capital offense under sections 182.1, 187, and 190 of the California Penal Code.1 He was charged by criminal complaint on December 2, 1969, in the Municipal Court, Modesto *533Judicial District, County of Stanislaus, State of California, and a warrant for his arrest was issued on that date.
