This matter is before the court on the Motion to Dismiss [DE-9] filed by Defendant Green Tree Servicing, LLC (“Green Tree”). This motion has been fully briefed and is ripe for ruling. Also before the court is the failure of Plaintiff Tiffany Misel f7k/a Tiffany Macias (“Misc.”) to respond to the “Notice to Plaintiff of Failure to Make Service Within 120 Days” [DE-15].
