This suit was brought by the appellees against the appellants to recover damages for backing water upon their mill wheels.
The complaint states that the appellees were the owners, since 1865, of a tract of land in Delaware county, which is particularly described, and upon which there was situate a saw mill and a woollen mill; that they and their grantors *43had owned and operated said mills continuously for thirty years, at a profit of $25 per day, until interfered…
