This is an appeal by one of two trustees appointed by the Circuit Court of Baltimore City to execute the trusts under the will of Charles Gerke. That will was first before this Court in the case of Gerke v. Colonial Trust Co., 114 Md. 289, under a proceeding- to obtain a construction of it in so far as the rights of Charles G. C. Ross, the grandson of the testator, were involved. The testator appointed his wife, Elizabeth Virginia Gerke, and Augustus E. Leidenroth executors and trustees of the will.
