The majority of this court, speaking through Special Associate Justice SEARCY (appointed by the Governor because of the disqualification of Associate Justice SMITH) have delivered an opinion upon the questions involved in this case, and it is with some regret that I feel called upon to dissent from the conclusions reached by the majority. That regret is based upon the profound conviction that their decision is unsound, and does violence to the Fourteenth and Fifteenth Amendments to the Constitution of the United States.
