Appeal by the plaintiff, Thomas J. Outerbridge, from an order of the Supreme Court, made at the Kings County Special Term and entered in the office of the clerk of the county of Kings on the 2d day of July, 1903, as resettled by an order entered in said clerk’s office on the 10th day of July, 1903, vacating an attachment theretofore granted in the action, against the property of the defendants.

Hirschberg, J.:
The-order vacating the attachment was granted by the justice of the Supreme Court who issued it. It was -granted upon the *598original \papers and no opinion was written. An examination of the' points made by. the learned counsel for the respondents discloses but one which appears to justify the order, and upon that alone can an affirmance be predicated, although that goes to the foundation of the action, and the order permits a renewal of the application for an attachment “ upon further and additional papers.”
