Appeal from a judgment of the County Court of Albany County (Turner, Jr., J.), rendered July 10, 1984, upon a verdict convicting defendant of the crimes of falsifying business records in the first degree and grand larceny in the third degree (two counts).

Defendant, a Thruway toll collector, was the subject of two separate indictments returned in July 1983. The first indictment charged defendant, Michael Viscusi and Suzanne Ciembroniewicz with one count of grand larceny in the second degree, alleging that the three stole property valued in excess *930of $1,500 by replacing Thruway toll tickets…
