RULING ON DEFENDANTS’ MOTION TO DISMISS [DKT. NO. 9]

HALL, District Judge.

Defendants Russ Larson, Jeff Hastings, and Ernest Lowe (“defendants”) move this court to dismiss plaintiff John DeRay’s claims against them for'failure to state a claim on'which relief can be granted. Fed. R.Civ.P. 12(b)(6). For the following reasons, their motion is granted.

I. BACKGROUND

DeRay, a Connecticut citizen, was hired by the Otis Elevator Company as an elevator mechanic in May 2001. Otis terminated his employment on February 6, 2002, purportedly for failure to wear a safety harness in accordance with Otis’s…
