On March 14, 1994, the defendant, Errol Goffe, was issued a summons charging him with two counts of operating an overweight commercial motor vehicle, owned by him, in violation of General Statutes § 14-267a.* 1 On October 3, 1994, a trial to the court was held in which an assistant state’s attorney presented *456the state’s case.
