This is an action for declaratory, injunctive, and other relief filed by Briar-cliff Haven, Inc. [Briarcliff] against the Department of Human Resources of the State of Georgia [DHR], David ' Matthews, Secretary of the Department of Health, Education and Welfare [HEW], and others, in which Briarcliff alleges two related causes of action. First, Briarcliff claims, in its original complaint, that provisions in the Georgia Medical Assistance [Medicaid] Plan which deal with reimbursements to nursing homes and intermediate care facilities are unfair to plaintiff…
