OPINION

Before the Court are five motions by Defendants Robert Menendez and Salo-mon Melgen to dismiss the indictment in this criminal action. Defendants challenge Counts One through Twenty-One of the indictment for failure to allege an “official act” within the meaning of the bribery statute, 18 U.S.C. § 201.
