The court has under consideration Defendant’s Motion for Summary Judgment (doc. 26) and a Motion For Leave to File Separately Attachments to Declarations of Mark Scarborough and John Ford Submitted with Memorandum in Support of Defendant’s Motion for Summary Judgment (doc. 28).
