SIMONTON, Circuit Judge.

This case now comes up upon the report of the special master under the order of 26th September last. A recapitulation of some of the facts of the case is necessary. The government concluded a contract with James It. Lawrence for building a courthouse and post office in Greenville at and for the sum of $76,290°. The building has been completed and accepted. Payments were made to Lawrence from time to time as the work progressed; in all, $67,999.01. There has been withheld by the government, from the contract price, the sum of $7,601.06.
