The subject of this suit is a B80 office computer, purchased by Bruffey Contracting Co., Inc. (Bruffey) from Burroughs Cor-portion (Burroughs) in May 1977. Bruffey was never satisfied with the performance of the computer, and finally announced its desire to repudiate the contract of sale in September 1978. The question is whether, based on the facts presented at trial and under the legal doctrines applicable, it will be permitted to do so or, alternatively, to recover damages.
