Liddon, C. J.:

The plaintiff in error was indicted in the Circuit Court of Marion county for the murder of Moses Williams. At a trial had at the Spring term, 1894, he was convicted of murder in the first degree and sentenced to death. I-Ie assigns the following errors as having been committed by the court below: 1st. Refusing motion for a continuance. 2nd. That proper-oath was not administered to jurors. 3rd. Refusal of court to give charges asked for by defendant. 4th.
