This is an action to foreclose a mortgage. When the ease was called for trial, a jury was called to act in any advisory capacity, and returned a verdict for'the defendants, which verdict was approved by the court, in findings of fact, and conclusions of law, and judgment was duly entered thereon.

Thereafter the plaintiff upon notice, moved the court for an order permitting plaintiff to open the case for the purpose of introducing in evidence an affidavit by the defendant, and at the same time moved the court to set aside the judgment entered in said action, and to make findings of fact and…
