We allowed petitioner habeas corpus directed to the superintendent of the Detroit house of correction with ancillary certiorari to the recorder’s court of Detroit, to inquire into the legality of his detention in said prison. The matter has been submitted' on typewritten returns and printed briefs.

On February 10, 1944, petitioner Frank Rudnik 'pleaded guilty in recorder’s' court to a charge of breaking and entering a building in the nighttime, with intent to commit larceny therein.
