Hinman, J.:
The plaintiff brought this action to recover damages for the death of his daughter, a child of about three and one-half years of age, alleged to have been caused by the negligent operation of an automobile owned and driven by the defendant. The accident happened in June, 1921, in the city of Binghamton. The court submitted to the jury the question whether the death of the deceased was caused by the negligence of the defendant, which the jury answered in the negative.
