Plaintiff, Bolte, appeals from the judgment of the circuit court granting defendant AITS, Inc.’s motion for summary judgment and attorney’s fees.

We reverse.

Plaintiff and defendant entered into an agreement whereby plaintiff was to receive from defendant a commission of 20% of the cost of the premiums of all insurance placed on a certain hotel. Defendant failed to pay plaintiff his first commission of $1458 and plaintiff filed his first action against defendant in the district court on July 2, 1971.
