Plaintiff sues for a declaratory judgment that a judgment in his favor against one Caldwell, the owner, for the foreclosure of his motor vehicle lien upon Caldwell’s automobile given by 2 Mason Minn. St. 1927, §§ 8524-8528, 2 is superior and prior to the title to the automobile acquired by defendant Republic Finance Company as purchaser at the foreclosure sale under a subsequent chattel mortgage upon the automobile in which it was the mortgagee.
