— In April 1837, the plaintiff and defendant entered into a partnership for the purpose of buying and selling lumber, which was continued until the latter end of August in the same year, when they gave up the business: Something better than two years afterwards, Preston made out an account of their partnership transactions, stating the moneys paid out and received by each, and showing a difference in his own favour of $473.65.
