Smith, J.
The issue in this case is whether the Statute of Limitations was tolled during all or any of the periods between December 19,1991 and February 24,1998 due to defendant’s “continuous” absence from the State following his alleged commission of the crime on July 4, 1988. We conclude that because defendant, a nonresident, remained, during legally significant periods of time, continuously outside the State within the meaning of the tolling provision of CPL 30.10 (4) (a) (i), the instant prosecution was timely commenced, and the order of the Appellate Division should be…
