The plaintiff, a student at Notre Dame University in South Bend, Ind., and residing in New York city, sues for the value of a leather traveling or kit bag and its contents. On the morning of September 15, 1930, he arrived at the station of the Delaware, Lackawanna and Western railway at Hoboken, N. J., to take a special students’ train about to depart for South Bend, Ind. His mother and a friend of his, one Faippers, came there with him to see him off.
