Before this court is defendant Shell Oil Company’s motion for partial summary *677judgment filed pursuant to Rule 56(b), Federal Rules of Civil Procedure.1 By its motion, Shell Oil Company (hereinafter “Shell”) seeks to persuade this court that the claims against Shell by royalty owners (hereinafter the “excluded royalty owners”) who only recently elected to be included in this class action lawsuit between plaintiffs and Shell over royalty payments are time-barred by § 15-1^19,2 Miss.Code Ann.
